Definitions - In these Terms & Conditions "The Seller" means Silvertown Health and "The Buyer" means the purchaser of the goods from the seller under these terms and conditions 1. Information about us 1.1 The seller operate the websites s://www.silvertownhealth.co.uk (as the context permits) shall be referred to as "Our Site" for the purposes of these terms and conditions. We are Silvertown Health at Venture House, 7 - 9 Lund Street, Preston, PR1 1YH, United Kingdom 1.2 Copyright in our site belongs to Silvertown Health. 2. Making a Purchase 2.1 We accept debit / credit card orders by telephone or online at s://www.silvertownhealth.co.uk. All card transaction processing is handled by Paypal in a safe encrypted and secure online environment. 3. Age 3.1 By ordering goods you confirm you are at least 18 years old. 4. Price 4.1 The price of goods and services and any offers are correct at the time of point but are subject to change without notice. Any orders awaiting dispatch that have already been paid in full will not be liable to price change. 5. Payment 5.1 Payment of goods are due in full before dispatch. 6. Returns Policy 6.1 "The Seller" accepts no liability for lost return of goods without a receipt or confirmation of postage. Any postage costs to return any goods to "The Seller" will not be the responsibility of "The Seller". When returning the goods "The Buyer" must enclose a letter confirming their name and address so the refund can be made to "The Buyer". 6.2 The decision to Return - For some it can take longer for a product to be beneficial. Always read the recommended use section of each product so you know how long you should take it for to get the best results. On this basis please take this into consideration when making your decision to return the product under the distance selling regulations. 6.3 Goods must be inspected on delivery and any claim for shortages or damages must be advised to "The Seller" within 48 hours of receipt. 7. Orders Outside on the UK 7.1 If you order Products from "The Seller" for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties, taxes or holding charges. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. 7.2 Please also note that "The Buyer" must comply with all applicable laws and regulations for the Products in which the country are destined to be delivered. We will not be liable for any breach by you of any such laws. 7.3 If an order outside of the UK is made we can not be held responsible for any delay or restrictions by the Customs regulations of the said country. It's "The Buyers" responsibility to ensure the product can be delivered and purchased in "The Buyers" country of delivery. Please contact your local customs office for further information before placing your order. 8. Refunds Policy 8.1 The "Buyer" has the right to return the goods and cancel their order up to and including seven working days from the day after "The Buyer" receives the goods in line with the current Distance Selling Regulations. The goods must be returned unopened and in the condition they were dispatched in for a full refund to be issued to "The Buyer". Postage costs for the return must be paid for by "The Buyer". In the event of the return been lost in the post proof of postage must be provided by "The Buyer" for a refund to be given. All returns to be sent to Silvertown Health,Venture House, 7 - 9 Lund Street, Preston, PR1 1YH. 8.2 The Distance Selling Regulations are not applicable if the order has been made for a business or sole trader or on behalf of a business. In this instance once the goods have been ordered they are deemed as sold and no cancellation or refund can be done under any circumstances unless the goods are faulty. 9. Delivery of Goods 9.1 All goods will be dispatched within 48 hours of the order Monday to Friday subject to stock availability. If the products ordered are out of stock we will notify you in writing with an option for you to cancel your order free of charge if the estimated delivery date is not acceptable to you. 10. Warranty We warrant to you that any Product purchased from us through our site will, on delivery, conform in all material respects with its description, be of satisfactory quality, and be reasonably fit for all the purposes for which products of that kind are commonly supplied. 11. Our liability 11.1 Subject to clause 11.2, if we fail to comply with these terms and conditions, we shall only be liable to you for the purchase price of the Products. 11.2 Nothing in this agreement excludes or limits our liability for: death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation;
any breach of the obligations implied by section 12 of the Sale of Goods Act 1979;
defective products under the Consumer Protection Act 1987; or
any other matter for which it would be illegal for us to exclude or attempt to exclude our liability. 12. Use of Goods 12.1 Goods are sold on the understanding that they will be used for their intended purpose only. No responsibility will be accepted by "The Seller" for the health risks taken by the "The Buyer" in using any of the products or services. If you are in doubt about using any of the Silvertown Health products listed refer to your GP for advice. 13. Website Information 13.1 We strongly recommend that any user of our products consult with their doctor before starting any physical exercise and/or dietary or supplement programme.
